Before any use of the website maison-demaille.com (hereinafter the "Site") and its services, the User is invited to read these Terms of Use (hereinafter "TOU") governing the use of the Site and its services by any individual accessing it either as a private person (visitor or customer) or professional (hereinafter "User" or "Users"). If the User does not agree with all or part of these TOU, they are asked not to use the Site and its services.

These ToU are accessible at any time on the Site and prevail over any other version or contradictory document if applicable.

1. Presentation of the Site

The Site is published by the company Maison Demaille, specialized in the online sale of high-end interior decoration.

Maison Demaille offers its customers an experience around the art of living, light, and design objects, with a chic and refined visual identity.


2. Purpose of the ToU

These Terms of Use define the conditions of access, browsing, and use of the Site by all Users.

By accessing the Site, the User acknowledges having read, understood, and accepted without reservation these ToU.


3. Access to the Site

Access to the Site is free, open to anyone with an internet connection. The User is solely responsible for the proper functioning of their computer equipment and internet access.

To benefit from the services offered on the Site, the User must:

  • Have the legal capacity to use the services offered on the Site;

4. Account Creation and Orders

Access to certain features (product purchases, order tracking, preference management) requires creating a personal account.

The User commits to providing accurate, complete, and up-to-date information. They are responsible for the confidentiality of their login credentials and any activity under their account.

To create an account on the Site, the User must:

  • Be of legal age;

  • Have the legal capacity to contract and purchase the products and/or services offered on the Site;

  • Use the Site in accordance with these TOU, the Site’s Terms and Conditions of Sale, and applicable law.

Maison Demaille reserves the right to suspend or delete any account in case of violation of these TOU or fraudulent activity.

Conditions related to orders, payments, and deliveries are specified in the Terms and Conditions of Sale (TCS) available on the Site.


5. Security

Using a strong password is essential to protect the account. The User must choose a password complying with Maison Demaille’s security requirements: alphanumeric, at least eight (8) characters long, including three (3) special characters (uppercase letters, lowercase letters, numbers, special characters).

Login credentials are personal, confidential, and non-transferable. The User must guarantee their confidentiality and security, and immediately request a password reset from Maison Demaille in case of loss, forgetfulness, or theft. Maison Demaille cannot be held responsible for any use of the account by a third party who accessed the User’s login credentials, whatever the cause.


6. Account Deletion

The User may delete their account at any time by contacting Maison Demaille at the contact details provided above. Personal information associated with the account, including order history if applicable, will be retained by Maison Demaille according to the retention periods specified in the privacy policy and legal requirements.

By deleting their account, the User loses all points, rewards, codes, promotions, and any vouchers or credits they held.


7. Intellectual Property

The Site, its architecture, contents (texts, images, illustrations, graphics, videos, logos, drawings, animations, etc.) as well as all products produced and sold are the exclusive property of Maison Demaille, protected by national and international intellectual property laws, and are therefore protected against any unauthorized use under the law or these TOU under penalty of legal action.

Any reproduction, representation, distribution, modification, adaptation, or exploitation, in whole or in part, of the Site or its elements by any means whatsoever, without the express written authorization of Maison Demaille, is strictly prohibited.

Non-compliance, especially for commercial exploitation, may lead to legal action for counterfeiting and/or unfair competition and/or parasitism by the rights holders. This is without prejudice to other rights Maison Demaille may have, including the right to claim damages.

Maison Demaille grants the User a personal, non-exclusive, free right to browse and use the Site and its services for their own use and strictly within the operations authorized under these TOU.

Maison Demaille offers unique design products, carefully selected or made. Photographs, texts, and product sheets are presented with great attention to quality and accuracy.

However, variations in color or texture may appear depending on the screen or materials used and cannot be considered defects or grounds for claims.

The blog « Inspiration & Raffinement », accessible from the Site, aims to inspire visitors with editorial content about design, elegance, and art of living. These contents are protected as part of the Site.

Maison Demaille reserves the right to terminate its contractual relationship with the User immediately, without notice or compensation, and to block any future access to the Site and its services, including the User’s account if applicable.


13. Modification of the ToU

These ToU are dated and may be modified and updated by Maison Demaille at any time, notably due to Site evolution.

Applicable ToU are those published on the Site at the time the User accesses the Site. The User is therefore invited to review the ToU at each new visit.

This version of the ToU supersedes all previous versions.

Any change in applicable law or decision by a competent court invalidating one or more clauses hereof does not affect the validity of the entire ToU. Such change or decision does not authorize the User to disregard the valid provisions.


14. Applicable Law – Disputes

These Terms of Use are governed by French law. Failing an amicable resolution, the dispute will be brought before the competent French courts.

These Terms of Use are written in French. In case of translation into one or more languages, only the French version shall prevail in the event of a dispute.
